Dependents ITIN Tax Question. Urgent!! Thanks for your info in advance.

I just worked in US for one month last year. I have SSN. I know I don't need to file my tax for 2004 in US because of the short stay; however, I would like to get some money that was deducted from the pay checks back.

I realize that I need to use 1040NR to file my US income tax for 2004. However, my wife and kids are still in Canada. Certainly, I don't have ITIN (Individual Taxpayer Identification Number) for any of them; and, there is no enough time to apply. Just about 7 days are left.

I need to claim them as my dependents. Without ITIN, it does not seem possible. What should I do?

Please share your experience and info. Thanks a million!

    • 1。可以申请她们的ITIN 再申请延期,有了ITIN,再交你的税表。 2。可以申请她们的ITIN 的表和你的税表一起交。
    • How much you can really get by adding them as dependents. Read again. If you only work in 1 month, no big money at all.
Your wife is not in US, she can not get ITIN. Right now even ITIN takes a lot of time to get and your wife need to send passport copy to IRS.

If you want to save money, fill as resident and claim EIC. You will find US governmetn give you more money than your paid tax.
      • Can I file as Resident for just staying here for a month?
I read the Instructions. I don't fall into Resident in 2004 (Will be in 2005 though).

I heard that if we file the tax using regular 1040, IRS won't give you the credit.
        • 1. you can not file regular 1040; 2. If you file Reguar 1040 you must include all your income. 3. file as non-resident won't save you much money at all, a common asumption but untrue.
if you make an obvious mistake, IRS will examine your return every year.
