1. Change of Status. Under this scenario, we would file an H-1B/H-4 petition with the USCIS here in the U.S., asking that your and your family's immigration classifications be changed from TN/TD to H-1B/H-4. Once approved, as of October 1, 2007, your classifications would automatically be changed to H. Please note that if we file this way, you and your family will be prohibited from traveling outside the U.S., even to Canada and Mexico, during the entire pendency of the petition.

2. Notify the Office. Under this scenario, an H-1B petition only (no H-4), would be filed with the USCIS requesting that you be approved for H-1B status. After the petition was approved and sometime in the 10 days prior to October 1, 2007, you and your family would have to go to Canada, and be admitted into the U.S. in H-1B/H4 status. There are no travel restrictions with this option - but it does require that you and your family go to Canada to be re-admitted in the new classification.
