You must get the CRA approval letter for non-resident tax. Here are my answers to your questions

本文发表在 rolia.net 枫下论坛1. CRA will decide whether you are non-resident for tax based on many reasons. One of them is whether you have family tie in Canada.

2. Normally the date that your family left Canada is the date you became non-resident for tax. For your case, your wife left Canada in April 2007, so if you handed in your NR-37 and get approval from CRA about non-resident for tax, you will be noticed clearly in the CRA letter from WHICH date you are non-resident for tax. I would guess it is April 2007.

3. If you really want to save tax but do not want to cancel all bank accounts, credit cards or RRSP, etc. in canada, all you need to do is to change your address in these accounts to your USA address. So the government will take it into consideration and might still give you approval of non-resident for tax.

4. Once you change to non-resident for tax, you will not be able to claim Canada tax online, but have to do it in paper.

          • Yes. Both of your are departing resident which is resident with a departure date. You don't report US income after April.

      • 好像不是必须要税局裁决, 你才是非税务居民, 只有你情况不明确时, 需要填这个NR-73表裁定.
        • My company in-house lawyer and my US account both told me that to get Canada non-resident for tax officially I needed the approval letter from CRA, because CRA is the authority. Otherwise if there is anything wrong in the future, no one can help you.
          • If they deny your non-resident status, no one can't help you either. It is better not to file NR-73 until they ask for it, if you think you are well qualified.
            • you can follow the denial letter to change your conditions until CRA approves you. BUT once the CRA finds something wrong and follows you, you will be in trouble forever and pay back a lot of tax money. Unless you will never go back to Canada.
              • I faxed the NR-73 form more than 6 weeks ago, I have not heard from them, yet. If they decided me and my wife to be non-resident from May, can I still file tax as resident for 2007?
                • the problem is, after May, she still received maternity EI and CCTB and UCCB. If she is determined to be non-resident, will we have to reply these benefits? Thanks.

    • If you and your wife passed the 183 days test, both of you can be us residents and file jointly in usa. You and your wife were treated as non residents and thus us residents after departing date without taxhome in canada.
      When you claim as resident of a country, you have to report your world-wide income for that period. That means your wife has to report maternity EI to both usa and canada. However, you can claim foreign tax credit if there is any after you minus total tax paid by all refund from canada for your wife. I can confirm that you do not need to repay maternity EI, but have to report to canada when you leave and your UCCB and CCTB stop after your child were outside of canda and thus you have to return UCCB and CCTB the part you are not qualified.
