when H1B petition is pending, you go out of US, which does NOT mean you give up your H1B petition, but mean that you give up your change of status (TN->H1 or TN extension). if you (your company) apply a new H1 petition for you and a COS at the same time (this is a very common way), you can work even when your TN expired (between april 1 and oct 1 or whatever the date you get your H1 denial). But, if you leave the country, you automatically terminate your COS application. So, you can only come back and work under TN status.

you'd better talk to your lawyer. terminating TN->H-1B only means your H-1B will not automatically be in effect on Oct 1, so you have to get your I-94 stamped (H1) at the border. you can always work under TN status until you change it to H1. -usersuserid(昵称); 2009-4-6 {374} (#5175036@0)
remember, your company (not you) applied H-1B petition for you. H-1B petition application will not be terminated because of your leaving the US. once your H-1B petition is approved, you can always change your TN to H-1B at the border (get stamp). so, as long as you can go to the border to change your status after Oct 1, you actually don't need to apply TN->H-1B transfer.

After you get approved, usually you do not have trouble for travel because you may have valid TN.
