Both Globe and Mail's editor and court said CAS was right and the child should continue to receive chemotherapy

Children who are dying of cancer do not, and should not have, the right to reject potentially life-saving medical treatment. Child-welfare authorities in Hamilton were right to ask for a court order forcing an 11-year-old boy to receive chemotherapy. And the court was right to give the order.

    • there were 5 speakers involved in the interview. I can't see how these 5 speakers could show how widespread and deep the concern about CAS was. At least Globe & Mail's ediitor and the judge agree CAS was right.

      • so out of 100 cases, there would be 0.8 child in the custody of CAS. Do you mind to provide some more statistics, e.g. top 5 reasons of investigation and top 5 reasons the child was taken away.

        • Off the top of my head, the 5 reasons of investigation include:
          1. Violence against women, or domestic violence - more than 40% of the total.
          2. Substance abuse including drugs and alcohol.
          3. Parent child conflict.
          4. Physical abuse.
          5. Special needs of the child - emotional, behavioural and physical.

          5 major reasons for admission into care:

          1. Substance abuse.
          2. Special needs.
          3. Parent child conflict.
          4. Sexual abuse.
          5. Violence against women.

          Victims of physical abuse have a very higher percentage of going home.

              Child sexual abuse occurs when a child is used for sexual purposes by an adult or
              adolescent. It involves exposing a child to any sexual activity or behaviour. Sexual
              abuse most often involves fondling and may include inviting a child to touch or be
              touched sexually. Other forms of sexual abuse include sexual intercourse, juvenile
              prostitution and sexual exploitation through child pornography.

A 1994 report, Child Welfare in Canada: The Role of Provincial and Territorial Authorities in Cases of Child Abuse, describes the provincial laws, definitions and child welfare systems that deal with child sexual abuse. A 1996 report, Child and Family Services Annual Report 1992-93 to 1994-95, presents statistical data on child welfare services in Canada. The available data cannot be directly or easily compared among the provinces because the information is collected according to different definitions and parameters in each province. For example, in some provinces, data on suspected cases are combined with those on confirmed cases. In other jurisdictions, sexual abuse is not distinguished from physical abuse.

                  Nonetheless, the following information provides some insight into the incidence of child sexual abuse.

                  • It is estimated that there were nearly 12 000 investigations of child sexual abuse in Ontario in 1993. Sexual abuse was substantiated in 29 percent of these cases and suspected in another 27 percent.

                  • In British Columbia, more than 500 complaints of sexual abuse were received in March 1992.

                  • The most extensive study of child sexual abuse in Canada was conducted by the Committee on Sexual Offences Against Children and Youths.       • one more question: what is the average duration before a child can go home with their parents?
        • Don't know right away - usually from a few days to a few months. If a child stays in care more than 6 months, the chance of a family reunion, based on previous experience, will diminish.

        • All reports received are subject to an assessment by the eligibility spectrum. Those not meeting the investigation requirements can be investigated but will not be paid by the government.

              • What's wrong with our society? Sometime, I wonder if our society is abusing the freedom that is given to us. A lot of people are so self center and they only care about themselves.
              • These obviously are clear cases of child abuse and are investigated with or without CAS. It would be outrageous if CAS didn't include them in the 38% investigated cases.
        • Just like calling the cops. Police has the discretion of investigating potential criminal matters, but not every report of incident. If the matter is criminal in nature, the cops are mandated to launch an investigation.
          • So if my father had an heart attack and I called 911. Police came with ambulance, my father was taken to hospital, I don't think the police would ever do any further investigation.
            • No, it is called request for police assistance. No further investigation is required, unless foul play is suspected.
        • Those not investigated are Report Received Full Investigation Not Required. CAS will have to document those report and provide a rational why investigation is not required.
          • If a child dies within 12 months, say during a car accident, CAS will have to report it to the Ministry and the PDRC, and it will become a statistic in the annual PDRC report, i.e. "how CAS killed 80 kids in a year".
